Fair Use Policy:

The Fair Use Policy of moCal builds on existing use restrictions and ensures that all customers can use the services equitably. Certain moCal features, such as notifications, may be aggregated and sent from fewer email or phone addresses or numbers. This indicates that multiple consumers are concurrently utilizing these features. If a single user places disproportionately high demands on the services, it may negatively impact the experience of other moCal users. The vast majority of our customers make considerate use of the service, and their consumption levels have no negative impact on service capacity. However, even the actions of a small number of customers who improperly utilize the service have the potential to have a substantial impact on the service for other customers.

The use of certain customer features, such as SMS notification, is perpetually monitored. Moris Media reserves the right, in order to defend its platform and other customers' usage, to restrict usage, suspend access, or charge fees for excessive usage when a customer generates an exceptionally high burden over a brief period of time. This policy will only affect consumers who consistently generate an exceptionally high burden over an extended period of time.

Your participation in Beta Services does not obligate you to purchase a subscription for any future paid Services. We reserve the right to modify, suspend, or discontinue any Beta Services, either in whole or in part, at any time without prior notice. moCal is not liable for any impact this may have on you or third parties.

Dispute Resolution and Arbitration; Class Action Waiver.
Please spend some time to properly read this section as it impacts your Legal Rights:

This clause facilitates the expeditious and efficient resolution of any dispute between us and you. Thus, "dispute" has the broadest meaning permitted by law and encompasses any claims against other parties relating to services or products provided or billed to you (such as our licensors, suppliers, dealers, or third-party vendors) whenever you also assert claims against us in the same proceeding.

This provision stipulates that all disputes between you and us will be resolved through binding arbitration, as your acceptance of these Terms constitutes a waiver of your right to litigate claims and to be heard by a judge or jury. We prefer arbitration because we believe it is less dramatic than litigation. To clarify, in arbitration there is no judge or jury, and court review of an arbitration award is limited. The arbitrator must adhere to the terms of this Agreement and has the same ability to award damages and relief as a court (including attorney's fees). YOU AND MORIS MEDIA AGREE THAT ANY AND ALL DISPUTES, AS DEFINED ABOVE, BASED ON ACTS OR OMISSIONS IN THE PAST OR FUTURE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION RATHER THAN IN COURT PURSUANT TO THIS PROVISION.

Pre-Arbitration Claim Resolution

You must first give us a chance to remedy or resolve any dispute by emailing us the following information at (1) your name, (2) your address, (3) a written description of your claim, and (4) a detailed description of the relief sought. If we are unable to resolve the dispute within 60 days of receiving your notification, you may pursue arbitration.

Arbitration Methods

If this clause applies and the dispute is not resolved as described above (Pre-Arbitration Claim Resolution), either you or we may initiate arbitration proceedings. Pre-identified arbitrators will arbitrate all disputes, and a single arbitrator will preside over the proceedings. The arbitration will be initiated as an individual arbitration, and not as a class arbitration under any circumstances. Whenever it conflicts with the applicable arbitration rules, this provision governs. The arbitration will not be subject to class action procedures or rules under any circumstances. Due to the interstate nature of the Services and these Terms, laws laid down under the Indian Constitution governs the arbitrability of all disputes. Nevertheless, the arbitrator will apply the applicable substantive law in accordance with the FAA and the applicable statute of limitations or condition precedent to suit. You or we may initiate arbitration in the courts of Kolkata, West Bengal, India.

Waiver of Class-Action Proceedings

The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action, or private attorney general action) unless both you and Moris Media agree to do so following the commencement of the arbitration.

You acknowledge and agree that by accepting this provision of these Terms, you and we are each waiving the right to a trial by jury or in a public court. If any clause within this provision (other than the Class Action Waiver clause above) is determined to be unlawful or unenforceable, that clause will be severed from this provision, and the remaining provisions will continue to apply. If the Class Action Waiver clause is determined to be unlawful or unenforceable, the entirety of this provision will be void and the dispute will be resolved by a court. This provision will survive the termination of your account with us or our affiliates, as well as the cessation of your use of this website. We agree that, despite any contrary provision in this Agreement, if we make any change to this provision (other than a change to the Notice Address), you may reject any such change and require us to adhere to the language in this provision in the event of a dispute between us.

General Terms:

We believe direct communication resolves the majority of issues; if we believe you are violating these Terms, we will likely inform you. If practicable, we might also recommend the necessary corrective action(s). Nevertheless, certain violations of these Terms, as determined by us, may necessitate the immediate termination of your access to this Website without prior notice.

Designated courts in Kolkata, West Bengal, India set as per provisions of the Indian Constitution govern these Terms to the utmost extent permitted by applicable law, without regard to preference or conflicts of law provisions. Except for disputes subject to arbitration as described above, any disputes arising out of or relating to these Terms or this Website shall be resolved by the courts of Kolkata, India. Except as otherwise provided in the dispute resolution provision, if any of these Terms are found to be inconsistent with applicable law, then such term(s) will be interpreted to reflect the parties' intentions, and no other terms will be modified. By choosing not to enforce any of these terms, we do not waive our legal rights. These Terms, along with our Privacy Notice, End User License Agreement, FERPA COPPA Privacy Policy, and the Data Processing Addendum (as applicable), Information Technology Act 2000, India constitute the entire agreement between you and us and, as such, supersede any prior or contemporaneous negotiations, discussions, or agreements between Moris Media and you pertaining to the Services. This Agreement incorporates by reference any and all definitions found in the Privacy Policy, End User License Agreement, FERPA COPPA Privacy Policy, Information Technology Act 2000, India and Data Processing Addendum. The rights granted to Moris Media by our Terms shall survive the expiration or termination of this Agreement. Any additional terms, conditions, consent, renunciation, alteration, or modification must be in writing and signed by both parties to be valid. Moris Media's acceptance of any order is expressly conditioned on compliance with the terms and conditions of this Agreement. Any proposed additional or inconsistent terms or conditions, including those in or accompanying any Customer proposal, any Customer purchase order, or other agreement or any other Customer document issued in connection with the sale or delivery of Products or Services, are regarded by Moris Media as a material change and are objected to and rejected. The acceptance of orders by Moris Media does not imply consent of the terms and conditions contained therein.

In no event shall Moris Media be liable to Customer, or deemed to have breached this Agreement, for any failure or delay in performing its obligations under this Agreement, if and to the extent such failure or delay is caused by circumstances beyond Moris Media's reasonable control, including but not limited to acts of God, flood, fire, earthquake, explosion, war, terrorism, invasion, riot or other civil unrest, strikes, epidemics, contractor difficulties, labour stoppages, or governmental restrictions.

Unless Customer has notified Moris Media to the contrary in writing (including via email to,, or, Moris Media may disclose your company as a moCal customer (if you use moCal for business purposes and/or use a business email address as your moCal User email address) and may use your company's name and logo on the Website and in Moris Media's promotional content. Moris Media will be granted a revocable, non-exclusive, non-transferable, non-sublicensable, royalty-free license ("Trademark License") to use, display, and reproduce such party's name, logo, trademarks, and service marks ("Trademarks"). Both parties acknowledge that the Trademark of the other party is and will remain the sole property of that party.

This Privacy Notice does not apply to Personal Data within Customer Data (as that term is defined in your agreement with Moris Media), such as information a User collects about an Invitee when an Invitee books a meeting or interview using our services. We process Personal Data within Customer Data on our customers’ behalf as a processor or service provider. If you are an Invitee and have questions about how your data is processed by our customers or wish to exercise your rights with respect to that data, you must reach out to the User who collected your information. If you contact us about Personal Data within Customer Data and are able to identify the company or User with whom you have interacted, we will promptly notify the relevant customer who collected your data of your inquiry.

Information We Collect:

We collect information about you directly from you and automatically through your use of our Website. To help you protect yourself and your information, we encourage you to provide and collect only that information that is necessary for using our Website. For example, to schedule a meeting, the only information that is necessary is names, email addresses, date, and time. Please note that if you choose not to share certain Personal Data with us, or refuse certain contact permissions, we might not be able to provide certain parts of the Services.

A User may connect their calendar with moCal. Our calendar integration only checks the duration and free/busy status of the events in your calendar so that we don’t book you when you’re busy. Although connecting your calendar to our services makes the scheduling process much more efficient, you are not required to connect your calendar to use our services. More information about access the moCal app and extensions have to your connected calendar is available here. moCal processes the calendar information on the User’s behalf as a processor or service provider. (For Prelude Service Users Only), the Prelude service works a bit differently. Moris Media will have access to the duration, free/busy status of the events in your calendar, attendees, start time, and the title of these events. We need this information in order to understand which events are movable on a User’s calendar so interviews may be scheduled more seamlessly.)

Information Received from the Third Parties

If you choose to connect your account to your account with a third-party service, we may receive or be granted access to information from such third-party service, including Personal Information. You can stop sharing your information from a third-party service with us by removing our access to that service. moCal processes that information on the User’s behalf as a processor or service provider.

This ensures swift action in the event of a data breach or security incident, minimizing potential harm. General Community Conduct:

At moCal, we strive to maintain a community where openness, respect, and professionalism are the cornerstones of every interaction. Our general conduct guidelines are designed to create a welcoming and constructive environment, where all members feel valued and empowered to participate.

Respect and Professionalism

Above all, we expect all community members to treat each other with respect. Every interaction should be professional, courteous, and considerate. Diverse opinions and perspectives are encouraged, but they must be presented thoughtfully and without belittling others. Derogatory, offensive, or discriminatory language is strictly prohibited and will not be tolerated.

Constructive Engagement

We encourage members to engage constructively - offering solutions, sharing insights, and providing supportive feedback. It’s through positive and productive discussions that our community thrives. We ask members to avoid confrontational or aggressive behavior that could lead to conflicts or unproductive arguments.

No Harassment or Bullying

Harassment in any form is unacceptable. This includes bullying, intimidation, direct or indirect threats, and personal attacks. We are committed to creating a safe space for everyone, free from fear of harassment or mistreatment.

Appropriate Content

All posted content must be appropriate and relevant to the moCal community. Avoid posting spam, explicit material, or content that violates intellectual property rights. Members should not use the community for self-promotion or commercial solicitation unless specifically permitted.

Reporting Misconduct

If you encounter any behavior or content that violates these guidelines, please report it immediately. We rely on our community members to help us maintain these standards.

By adhering to these guidelines, each member contributes to a healthy, productive, and enjoyable community experience. Our collective responsibility is to uphold these standards, ensuring moCal remains a place of positive interaction and valuable collaboration.

Content Sharing and Posting Guidelines:

At moCal, we encourage active content sharing and posting, as it drives the exchange of ideas, solutions, and experiences within our community. To ensure these contributions are valuable and appropriate, we have established the following guidelines:

Relevance and Accuracy

Content shared should be relevant to moCal and its community. It should contribute to the conversation, providing accurate, useful information or seeking genuine assistance. Misleading or false information undermines the trust and integrity of our community and is not permitted.

Intellectual Property Respect

Honour intellectual property rights at all times. Share content you have the right to distribute and give proper credit for others’ work you may reference. Plagiarism, copyright infringement, or sharing pirated materials are strictly against our policy.

No Inappropriate Content

Avoid posting content that could be deemed offensive, inflammatory, or not safe for work. This includes avoiding explicit language, graphic imagery, or any material that could be considered discriminatory or harmful.

Clear and Respectful Communication

Ensure your posts are clear and easy to understand, avoiding excessive jargon or technical terms that may not be widely recognized. Be respectful and professional in your tone, even in disagreements or debates.

Avoiding Spam and Self-Promotion

Refrain from sharing unsolicited promotional material, advertisements, spam, or irrelevant links. While sharing personal experiences and recommendations is valuable, overt self-promotion detracts from the purpose of our community.

Adhering to these guidelines ensures that the content shared within the moCal community is constructive, respectful, and beneficial to all members. By fostering responsible content sharing, we can maintain a rich, informative, and engaging community environment.

Engagement and Interaction:

In the moCal community, vibrant and meaningful interactions form the foundation of our shared learning and growth. To cultivate a space where every member feels encouraged to engage and interact, we emphasize the importance of constructive and respectful communication.

Encouraging Constructive Dialogue

We urge members to engage in discussions that are positive and productive. When replying to others, consider the value your response adds to the conversation. Offer solutions, share experiences, or provide constructive feedback. We believe every interaction is an opportunity to support and uplift one another.

Respectful Responses and Criticism

When disagreeing with an opinion, do so respectfully. Focus on providing constructive criticism and alternative perspectives without disparaging the individual. Remember, a respectful tone and polite discourse are essential, even in disagreement.

Navigating Disputes

In any community, disagreements are natural, but how we handle them makes all the difference. If a discussion becomes contentious, we encourage members to de-escalate the situation by steering the conversation back to a constructive path or, if necessary, seeking moderation from the community team.

Encouraging Diverse Perspectives

Our community is strengthened by its diversity. We encourage members to listen to and appreciate different viewpoints. Understanding that each member brings unique experiences and knowledge leads to richer, more informative discussions.

Avoiding Miscommunication

Online communication lacks the nuances of face-to-face interaction. Be mindful of how your words may be perceived. Clear and thoughtful communication reduces misunderstandings and fosters a more harmonious environment.

By embracing these principles of engagement and interaction, members of the moCal community contribute to a supportive, enriching, and dynamic environment, where every member feels valued and empowered to participate actively.

Privacy and Confidentiality:

In the moCal community, we deeply value and respect the privacy and confidentiality of our members. Upholding these principles is vital to maintaining trust and integrity within our community.

Safeguarding Personal Information

Members should be cautious about sharing their own or others' personal information. This includes, but is not limited to, phone numbers, email addresses, physical addresses, or any other personally identifiable information. Disclosing such details can potentially lead to privacy breaches and should be avoided in public posts or discussions.

Confidentiality of Conversations

We encourage openness and sharing, yet it’s crucial to recognize the public nature of our community. Discussions that involve confidential or sensitive information, particularly about business practices or client details, should be handled with discretion. If in doubt, it’s best to err on the side of caution and not share.

Respecting Third-Party Information

Sharing third-party content or information in the community should always be done with respect for privacy and confidentiality. Ensure you have the right or permission to share any such information before posting.

Reporting Privacy Concerns

If you notice any breach of privacy or confidentiality within the community, we urge you to report it immediately. This helps us take prompt action to address the issue and maintain the safety and integrity of our community.

By adhering to these privacy and confidentiality guidelines, members help create a secure and trusting environment where open, yet respectful, conversations can flourish.

Reporting and Moderation:

In the moCal community, we rely on the collective effort of our members and moderators to maintain a positive and respectful environment. A crucial aspect of this is the reporting and moderation process, which helps address inappropriate content or behavior.

Reporting Mechanism

If you encounter any content or behavior that violates our community guidelines, please use the reporting mechanism provided. This could include offensive posts, spam, harassment, or other disruptive activities. Prompt reporting is essential in dealing with such issues effectively and maintaining the community’s integrity.

Role of Moderators

Our moderators play a key role in overseeing the community. They review reported content and take appropriate action, which may include removing content, issuing warnings, or in severe cases, banning members who consistently breach guidelines. Moderators also help facilitate discussions, ensuring they remain constructive and on-topic.

Timely Response

We strive to respond to reported issues in a timely manner. The community team regularly monitors reports and moderator interventions to ensure a swift and appropriate response.

Feedback and Appeals

We welcome feedback on moderation decisions. If you have concerns about a decision or wish to appeal against any action taken, please contact us directly. We aim for transparency and fairness in our moderation process.

By engaging in self-regulation and supporting our moderation team, community members play an active role in fostering a respectful and engaging environment for all.

Consequences of Policy Violations:

Adherence to moCal's community guidelines is critical for maintaining a respectful, informative, and positive environment. Violations of these guidelines are taken seriously, and we have established clear consequences to address them.

Warning and Education

In cases of minor or first-time violations, we typically issue a warning. Our aim is to educate members about the guidelines and encourage better practices. We believe in giving members a chance to understand and correct their behavior.

Content Removal

Posts or comments that breach our guidelines, such as those containing offensive language, spam, or irrelevant promotions, will be removed. This ensures that the community remains a valuable resource for everyone.

Temporary or Permanent Bans

Repeated violations or severe misconduct, like harassment or hate speech, will result in temporary or permanent bans from the community. These measures are necessary to protect the interests and safety of all community members.

Review Process

We ensure a fair review process for any actions taken. Members can appeal decisions by contacting the community team. This process allows us to consider individual circumstances and maintain fairness.

By enforcing these consequences, we aim to uphold the standards of our community and ensure that moCal remains a welcoming and constructive space for all members. It's through collective adherence to these guidelines that our community thrives.

Updates and Revisions:

At moCal, we understand that the digital landscape and community dynamics are constantly evolving. To ensure our guidelines remain relevant and effective, we regularly review and update them.

Continuous Review Process

Our team periodically assesses the effectiveness of the current guidelines, taking into account new challenges, community feedback, and changes in online interaction norms. This proactive approach ensures that our policies are up-to-date and continue to serve the community’s best interests.

Incorporating Feedback

Member feedback is invaluable in shaping our guidelines. We encourage community members to share their thoughts and suggestions on how we can improve. This collaborative approach helps us create guidelines that reflect the needs and values of our diverse community.

Announcements of Changes

Any significant updates to the guidelines will be communicated to all members through community announcements or direct notifications. We aim to ensure that members are well-informed of any changes and understand the implications for their participation in the community.

Adapting to Legal and Regulatory Changes

In response to new legal or regulatory requirements, we may revise our guidelines to ensure compliance while continuing to protect the interests of our community members.

Through this process of ongoing revision and adaptation, we strive to maintain a safe, respectful, and engaging environment for all moCal community members.

It's important to reflect on the core purpose these guidelines serve. They are not just rules to follow, but a manifestation of our commitment to fostering a positive, inclusive, and enriching environment for all members.

It represents our dedication to improving time management and efficiency for individuals and businesses alike. The moCal brand is not just a representation of our products and services but also an embodiment of our customer-first philosophy and our pursuit of excellence in every aspect of our operation.

Guiding Principles of Our Brand Policy:
  • Consistency and Integrity: We strive for uniformity in our brand representation across all platforms and touchpoints. This consistency reinforces our brand's integrity and aids in building a strong, recognizable identity.
  • Quality and Professionalism: Our brand reflects the high standards we set for ourselves and our products. Every use of the moCal brand is aligned with the quality and professionalism that our users expect from us.
  • Innovation and Progress: As a brand at the forefront of scheduling technology, we ensure that our branding communicates innovation, modernity, and a forward-looking approach.
  • Respect and Compliance: Adherence to legal standards and respect for intellectual property rights are non-negotiable aspects of our Brand Policy. We ensure that our brand usage always complies with legal requirements and reflects our ethical stance.
Application of the Brand Policy:

This policy applies to all representations of the moCal brand, including but not limited to digital and print media, communications, marketing materials, and any other form of brand expression used internally and externally. It is essential for all employees, partners, and affiliates to understand and adhere to these guidelines to maintain the integrity and effectiveness of the moCal brand.

Our Commitment:

At moCal, we are committed to upholding the principles outlined in our Brand Policy, fostering a brand that resonates with excellence, trust, and innovation. As we evolve and grow, our Brand Policy will adapt, always keeping in step with our core values and the expectations of our users.

Brand Name Usage:

In all communications, marketing, and branding materials, the name of our platform should be correctly referred to as "moCal." It is crucial to maintain this specific capitalization, with a lowercase 'm' and an uppercase 'C', to reflect our brand accurately and consistently. This format not only upholds our brand identity but also ensures recognition and professionalism across various platforms and mediums.

It's important to avoid any abbreviations, acronyms, or alternative stylizations that deviate from this standard unless they are officially provided and sanctioned by Moris Media. Such consistency in the usage of our brand name plays a vital role in maintaining the integrity and recognizability of the moCal brand in a crowded digital landscape. Ensuring uniformity in how our name is presented helps strengthen our brand presence and aids in building a strong, cohesive image that users, partners, and the public can easily identify and trust.

Logo Usage:

The moCal logo stands as a central element of our brand's visual identity, symbolizing our commitment to simplicity, efficiency, and innovation in scheduling solutions. It is imperative that the logo remains unaltered in any form. This includes maintaining its original colour scheme, proportions, and design elements without any modifications. The integrity of the logo must be preserved to ensure it remains a distinct and recognizable symbol of our brand.

When using the logo, it's important to avoid overlaying or merging it with other symbols, graphics, or text. Such practices could obscure the logo and dilute its impact. Additionally, sufficient space should be maintained around the logo, ensuring it's clearly visible and stands out in any application, whether it's digital media, print, or merchandise. This clear space acts as a visual buffer, enhancing the logo's prominence and safeguarding its position as a key representative of the moCal brand identity.

Colour Palette:

The moCal brand colour palette plays an integral role in shaping our visual identity. It's a carefully selected spectrum of colours that reflects our brand's ethos and personality. For all forms of communication, be it digital or print, it's essential to adhere strictly to this approved palette. This consistency in colour usage helps in creating a strong, memorable brand presence, ensuring that all materials associated with moCal are instantly recognizable and resonate with our brand values.

Typography is a key element in reinforcing the moCal brand identity. We have carefully chosen specific fonts that embody our professional and cohesive aesthetic. These fonts are to be used consistently across all communication channels to maintain visual harmony and brand recognition. The use of unauthorized fonts in any brand-related materials is strictly prohibited, as it can disrupt the visual consistency and the professional appearance we strive to maintain across all our brand touchpoints.

Voice and Tone:

At moCal, our brand voice is human, helpful, and confident, mirroring our approach to service and communication. We prioritize simplicity and clarity in our messaging, ensuring that every piece of written or verbal communication is straightforward and easy to understand. This approach is fundamental in making our brand more relatable and trustworthy. Whether it's customer support, marketing materials, or internal communication, our voice consistently reflects these core principles, resonating with our commitment to exceptional service and user-friendly solutions.

Visual Elements:

The imagery used in conjunction with the moCal brand plays a pivotal role in communicating our values and aesthetic. It is crucial that all images associated with moCal are of high quality, relevant, and reflect the professionalism of our brand. They should visually convey the essence of moCal and resonate with our audience. Usage of unprofessional or off-brand imagery detracts from our brand identity and is not permitted under any circumstances, as it can undermine the overall perception of the moCal brand.

moCal is a registered trademark of Moris Media, a designation that signifies our brand's uniqueness and credibility. It is essential that the moCal trademark is correctly identified and acknowledged in all instances of its use. Unauthorized use of the moCal trademark, without explicit permission from Moris Media, is strictly prohibited and subject to legal ramifications. This policy ensures that the trademark's integrity and value are preserved, maintaining the brand's distinct identity and reputation.

Co-branding and Partnerships:

All co-branding or partnership activities involving moCal must align with our brand policy and require prior written consent from an authorized representative of Moris Media. It is important that these collaborations harmoniously blend the branding elements of both parties, ensuring that neither overshadows the other. This balance is crucial in maintaining the integrity and recognition of the moCal brand while allowing for a mutually beneficial partnership.

Brand Policy Violations:

Any misuse or improper representation of the moCal brand should be promptly reported to Moris Media's Brand Management team. We take such matters seriously, and violations of our brand policy are subject to consequences. These can range from requests for corrective action to more stringent legal measures, depending on the severity of the violation. Our aim is to protect the brand's integrity and ensure that its use always aligns with our established guidelines and values.

Our brand represents a promise, a commitment that we make to our customers and stakeholders. It embodies the essence of what moCal stands for - innovation, reliability, and user-centric service. Adhering to this brand policy is not just about maintaining a consistent visual identity; it's about upholding the values and principles that moCal is built upon. By following these guidelines, we ensure that the quality and integrity of the moCal brand are preserved, thereby reinforcing our reputation in the market.

We understand that maintaining these standards consistently across various platforms and communications can be challenging. Therefore, we deeply appreciate your commitment to these guidelines. Should you have any questions, require clarifications, or need further guidance on how to best represent our brand, our Brand Management team is always available to assist you. Their expertise and support are invaluable in helping you navigate the nuances of our brand policy, ensuring that every representation of moCal aligns with our high standards and contributes positively to our brand's standing in the marketplace.
