moCal – FERPA and COPPA Privacy Policy and Notice
Effective from: 01st January 2024

Children under the age of 13 may only use the Services through an account created by and under their parent/legal guardian or school/educator; any other use is expressly prohibited. If Customer is a school or educator in the United States and wants its students to use the Services, Customer is responsible for complying with the U.S. Family Educational Rights and Privacy Act ("FERPA") and the Children's Online Privacy Protection Act of 1998 and its implementing regulations (collectively "COPPA").

To the extent that Moris Media has access to "education records" as defined by the Family Educational Rights and Privacy Act of 1974 and its implementing regulations ("FERPA"), it is deemed and shall function as a "school official" with "legitimate educational interests" when fulfilling its responsibilities under this Agreement, and both parties agree that Customer has "direct control" over the use of "education records" as defined by FERPA. Moris Media agrees to comply with its obligations under FERPA, including but not limited to the limitations on re-disclosure of personally identifiable information from education records set forth in FERPA, as well as the terms listed below.

Before its students register for or use the Services, Customer must notify these students' parents/guardians of the personally identifiable information it will collect and share with us and obtain their consent. Customer shall provide parents/guardians with a copy of our Privacy Policies when obtaining such consent. Customer must maintain all consents and provide them to us upon request. In addition, Customer is responsible for verifying the student-parent relationship and ensuring that the right of a parent to review personal information provided by a child is respected. Customer shall comply with such requirements by requesting and providing Moris Media with a data subject request for the aforementioned data, or any modifications to such data requested by the parent, and by providing the data to the parent following verification of the student-parent relationship. If Customer is located outside the United States, Moris Media shall rely on Customer to obtain any required consents or approvals from the parent or guardian of any student covered by similar laws, and Customer shall comply with such laws as a condition of Customer's and its students' use of the Services.

moCal Privacy Policy for Children:
Effective from: 01/01/2024

The Children's Online Privacy Protection Act of 1998 and the U.S. Family Educational Rights and Privacy Act ("FERPA") and their implementing regulations (collectively, "COPPA") require us to inform parents and legal guardians (as used in this policy, "parents") about our practices regarding the collection, use, and disclosure of personal information from children. Additionally, it requires us to obtain verifiable parental consent for certain acquisition, use, and disclosure of children's personal information.

This section notifies parents of:

  • The categories of data that may be collected from minors.
  • How we utilize the data we obtain.
  • Our policies regarding the disclosure of this information.
  • How we notify and obtain parental consent when collecting personal information from minors, as well as how a parent may revoke consent.
  • All operators who collect or store children's information through this Service.

This policy pertains exclusively to minors and supplements moCal's General Privacy Policy. The General Privacy Policy of moCal applies to adults.

The definitions of terms in moCal’s General Privacy Policy also apply to this Privacy Policy for Children.

Information Obtained About Children:

We collect information about you both directly from you and automatically as you navigate our website. We may combine automatically collected information with other information we have collected about you, including information from public sources.

To assist you in protecting yourself and your information, we encourage you to provide only the information required for using our website. To schedule a meeting, for instance, you may only need to provide us with your name, email address, meeting date, and time.

moCal obtains the following information, either directly from moCal Users, Invitees, or Viewers, or via third-party sources about Users, Invitees, and Viewers.

Appointment-Related Data

A moCal User, Invitee, or third party may provide us with information voluntarily. This may include names, email addresses, and phone numbers; email addresses of other individuals; the subject of the meeting; and any other information provided by the moCal User or mandated by the moCal Terms of Service upon scheduling. If you receive an invitation from a moCal User but do not desire to become a moCal User, please set up your meeting by contacting the moCal User who sent the invitation via an alternative method.

Date-Related Information

A moCal User can attach their calendar to the service. Our calendar integration only examines the duration and free/busy status of your events to avoid scheduling you when you're unavailable. We do not store who you are meeting with, their email address, the meeting's title, or any other information related to appointments in your connected calendar.

Information on billing

If you purchase a premium version of moCal, third-party payment processors will collect and retain your billing address and credit card details. We store the last four digits, card type, and expiration date of your credit card.

Information We Directly Collect:

To register for this website, a minor must provide the following information: first name, last name, and an email address. We require the creation of a password as well. We may request additional information, but it is entirely voluntary. When requesting information, we indicate whether it is mandatory or optional.

We enable users to communicate with others on or through this Service by means of forums, frequently asked questions, help and support services, feedback, and posting in public areas of the Site/Service ("Social Features"). These characteristics enable minors to disclose personally identifiable information. We neither monitor nor review this content prior to posting, nor do we control the actions of third parties with whom your child shares information. We encourage parents to teach their children about secure internet use and to monitor their use of social media features.

Subject to your opt-out preferences (see 'Your Rights and Choices' below), we use third-party Service Providers such as Google Analytics to provide certain analytics and Viewer interactions services to moCal in connection with our operation of our Website, including the collection and tracking of certain data and information regarding the characteristics and activities of moCal visitors. You can decline pertinent cookies by using the opt-out features on their respective websites.

Children can access and use certain portions of the Service and its content, as well as some of its features, without providing us with any personally identifying information. However, certain content and features are restricted to registered users or require us to collect information from them, including personal data. Additionally, we use certain technologies, such as cookies, to collect information automatically from our users (including minors) when they visit or use the Service.

We collect only as much information about a child as is reasonably required for the child to participate in an activity, and we do not condition the child's participation on the disclosure of more information than is reasonably required.

This includes facilitating scheduling, administering your account, responding to your inquiries, and other customer service and support-related activities. We also share account information with your bank to verify the legitimacy of a charge in the event of a credit card dispute.

For moCal Invitees, rest assured that we do not use the email addresses you provide to schedule a meeting with a moCal User to send any form of direct marketing.

We may contact you to inform you of changes to your services, our service offerings, and other important service-related notices, such as changes to the Notice or notices regarding security or misconduct.

Safeguarding Rights and Interests

We will use your information to protect our rights and interests, as well as the rights and interests of our Users and any other person, and to enforce this Notice or our terms and conditions.

Legal Compliance

Social Features:

The Service provides social features, such as posting on message boards, forums, FAQs, help and support services, feedback, and posting to public areas of the Site/Service, that enable children to communicate with others via the Website/App/Service. We have no control over the categories of information that your child can send or post using these services. We encourage parents to educate their children about online safety and to closely monitor their children's use of social features to ensure that they do not disclose any personal information.

Accessing and Modifying Your Child's Personal Data:
